Confidential Settlement – Student Discipline Case

A confidential settlement was reached in a student discipline case with Duke University, who suspended a student for six semesters after he was found responsible for sexual misconduct during Duke’s student disciplinary proceeding. In Doe v. Duke University, Emilia Beskind and Jay Ferguson filed suit against Duke in Durham County Superior Court on behalf of the student for Duke’s failure to abide by its own rules during the disciplinary proceeding which led to the suspension. The trial court initially entered an injunction prohibiting the student from being suspended, and then granted summary judgment for the student finding Duke had breached its contract with the student in its handling of the disciplinary proceeding. Just prior to trial, the parties then reached a confidential settlement in this student discipline case. The student was permitted to continue as a student in good standing with no disciplinary finding or record. ​
